These are the terms you buy under. They are written to be understood, because terms nobody can read protect nobody.
They are governed by Indonesian law — in particular UU No. 8 Tahun 1999 tentang Perlindungan Konsumen and UU No. 11 Tahun 2008 as amended by UU No. 19 Tahun 2016 on electronic information and transactions. Nothing here takes away a right those laws give you.
Who you are buying from
NHK Store, selling directly rather than through a marketplace. Everything on this site is sold and sent by us, from Jakarta, to addresses in Indonesia.
When an order becomes an order
Placing an order is an offer to buy. The sale is made when we accept it, which we do by confirming it to you by email. Until then there is no contract, and either of us can walk away without owing the other anything.
You do not need an account. You do need to give us details that are true — a name we can put on a parcel, an address it can reach, a phone number the courier can call, and an email you actually read. If those are wrong, the parcel goes to the wrong place, and that is not something we can put right for free.
Prices
Every price on this site is in Indonesian Rupiah and includes any tax due on it. Delivery is not included; it is worked out from your address before you pay, and shown to you before you commit to anything.
Prices can change, but not for an order already placed. The price that binds us is the one you saw when you ordered.
Very occasionally a price is plainly wrong — a helmet listed at a tenth of its value, a decimal point in the wrong place. If that happens we will tell you before we take your money, and you can pay the right price or have the order cancelled and refunded in full. We will not simply send the parcel and bill you the difference.
Paying
The ways you can pay are the ones offered at checkout. If you pay by bank transfer, the order is held until the money reaches us — telling us it has been sent is what starts that, and there is a form for it.
An order that is never paid for is cancelled, and the stock goes back on the shelf.
Delivery, and who carries the risk
We send by the couriers listed on the shipping page. The delivery estimates there are the couriers’ own and are estimates, not promises — but the parcel is our responsibility until it reaches you.
If it arrives damaged, or does not arrive at all, that is ours to sort out with the courier and not yours. Photograph the box before you open it if the packaging looks wrong: a courier claim cannot be made without that picture, and it is the one thing we cannot get later.
What is yours: being reachable. If the courier cannot find the address, cannot get an answer on the phone, and returns the parcel to us, sending it out a second time is charged again.
If something sells out after you have ordered
It should not happen — the site marks what has gone and refuses to basket it — but stock can be counted wrong. If it does, we will tell you and refund that part of the order in full. If it leaves the rest of the order not worth having, say so and we will refund all of it.
Sending things back, and warranties
Both have their own pages, which are the terms: returns and warranty. They say what we can take back, who pays the postage, how long you have, and what a warranty covers. Where those pages and this one appear to differ, those pages win — they are the ones written to be read before you act.
What the product pages promise, and what they do not
We describe every helmet as accurately as we can. Photographs are taken under lights, and screens differ: a colour may not be exactly what you see. Specifications come from the manufacturer and can change between production runs without our being told.
If what arrives is materially different from what the page showed, that is our problem to fix, not a difference you have to live with. If it is a shade of red you imagined differently, it is not.
Using a helmet
A helmet reduces the risk of injury. It does not remove it, and no helmet ever made does. Read the disclaimer, read what comes in the box, and replace a helmet that has taken an impact.
What we are not responsible for
We are responsible for the order: getting the right thing to you, in good condition, and putting it right when we do not. We are not responsible for losses beyond that which we could not have foreseen — a trip you missed, a job you could not take, income you did not earn because a parcel was late.
Nor for the site being unreachable while it is being worked on, or while something out of our hands is broken.
None of this limits what we owe you for death or injury caused by our own negligence, for a product that was faulty, or for anything else the law does not let a seller sign away.
When we may refuse an order
Rarely, and for reasons we will tell you: we cannot get the stock, the details do not add up, the payment does not clear, or an order is plainly for resale. Anything you have paid comes back in full.
This site sells to people buying for themselves. If you want to stock NHK helmets in a shop, write to us — that is a different conversation and a welcome one, but it is not this one.
If these terms change
The date at the top of this page is when they last did. A change never applies to an order already placed — the terms you bought under are the ones that were here on the day.
If we disagree
Tell us first. Most of what looks like a dispute is a misunderstanding that a reply clears up, and we would rather answer than argue.
If that fails, Indonesian law applies and the Indonesian courts decide. You keep every right consumer protection law gives you, including the right to take a complaint to BPSK — the consumer dispute resolution body — instead of to court.
Reaching us
Every way of doing it is on the contact page. A person reads what arrives.
